Background: Mr. Rabinowitz was born in Bloomfield, New Jersey. He attended Washington Square College of New York University, where he graduated in 1959, summa cum laude. He then went on to attend New York University School of Law where he graduated in 1962 with his law degree magna cum laude. Mr. Rabinowitz has practiced law in Florida, Michigan and Texas for over 40 years.
Mr. Rabinowitz has been involved in many other complex matters that spawned litigation in state and federal courts, including the bankruptcy courts in Florida, Michigan and Texas. His primary focus, when representing creditors, has been on the safest, quickest and economical way of recovering the most for them.
He has appeared and argued cases in three Federal Appeals Courts. At times, he has successfully represented debtors, in Chapter 11 cases. See In re James Bronce Henderson, 321 B.R. 550 (Bankr. M.D. Fla. 2005), aff’d, 341 B.R. 783 (M.D. Fla. 2006). The appeal to the Eleventh Circuit by the objecting creditor was dismissed, and the matter settled.
During the Texas savings and loan crisis, he was in engaged in monitoring and collecting the assets of three failed thrifts purchased by an affiliate of Pulte Homes. The REO (Real Estate Owned) of these three thrifts had a book value of over $1 Billion. Under the direction of the FDIC, Pulte was to act by all legal means to foreclose, sue and/or settle with the multitude of borrowers and guarantors who owed money to these failed savings banks. One of the major matters that Mr. Rabinowitz handled involved Mortgage Company of El Paso, which owed over $100 Million to one of the thrifts. The Mortgage Company filed for reorganization under Chapter 11 of the Bankruptcy Code. Mr. Rabinowitz succeeded in blocking its plan, and later seizing all of the assets of this company. See Mortgage Company of El Paso, 111 B.R. 604 (Bankr. W.D. Tex. 1990).
Over the years, Mr. Rabinowitz has represented plaintiffs and defendants in many other complex civil litigation cases in state and federal courts, including mortgage foreclosures. He has also participated in many out-of-court workouts, and assignments for the benefit of creditors.
Mr. Rabinowitz’ background provides for a well rounded understanding of the rules of debtor/creditor laws, and the ability to render a wide range of services to clients such as banks, credit unions and thrifts.
